Powered by WufooOn receipt of order form unless otherwise noted, SecureTrac Inc. will contact Clients to arrange on site inspection on premises designate by Customer. Unless otherwise noted, SecureTrac Inc. will confirm all information on equipment and location before inspection date is set. SecureTrac Inc. shall not be liable for failure to perform any of its obligations hereunder if such failure is the result of the failure of Client to promptly respond to SecureTrac Inc. request for confirmation. Customer understands and agreed that the accuracy of any information furnished is not guaranteed by SecureTrac and customer agrees to release defend and hold harmless SecureTrac, its officers, affiliates, agents, employees and contractors harmless from any and all liability for any negligence in connection with preparation and release of such report and from any loss or expense suffered by customer or anyone else resulting directly or indirectly from such reports. The maximum amount of liability per inspection is the total cost billed to Customer and Customer agrees to waive any and all other remedies it may have under the law. In the event Customer commences lawsuit against SecureTrac, Inc, its agents, affiliates, employees or contractors and it is found by the court of competent jurisdiction the SecureTrac Inc. was not liable to the customer, Customer expressly agrees to reimburse SecureTrac Inc for cost and related attorney’s fees incurred by SecureTrac as a result of the suit. SecureTrac Inc shall have no liability for any loss suffered by Customer that is occasioned by fraud or intentional wrongdoing on the part of the client or Clients employees.
